WAR AND RAPE: THE RESPONSIBILITY OF THE UNITED NATIONS IN THE FACE OF THE VIOLATION OF THE FUNDAMENTAL RIGHT TO WOMEN’S SEXUAL DIGNITY
Abstract
This article seeks to understand the responsibility of the UN in the face of the systematic sexual violations occurring in the war between Russia and Ukraine. To this end, it historically investigated how the international community understands and represses rape crimes in wartime contexts. It analyzed documents denouncing sexual crimes committed by Russian military personnel against Ukrainian civilians, as well as the measures the international community has adopted to address such violence. It also examined the UN’s responsibility in combating violations of the fundamental human right to sexual dignity and the measures adopted by the international community in response to these violations. The research is bibliographic in nature, involving an extensive documentary and journalistic survey of international electronic sources such as the UN (and related bodies), the International Committee of the Red Cross, the Organization for Security and Co-operation in Europe, the Council of Europe, The New York Times, Forbes, The Guardian, CNN, Veja, O Globo, among other international and national sources. The analysis indicated that UN Member States have assumed an International Responsibility to Protect civilians in situations of humanitarian crisis, grounded in international security, thereby committing to ensure the sexual dignity of women who are victims of wars and armed conflicts. Furthermore, they have established global goals — the SDGs — which include the eradication of all forms of violence against women and girls. In this sense, the UN and its signatory countries cannot justify negligence in addressing such violence based on the principles of sovereignty and non-intervention.
