THE EFFECTIVENESS OF ARTICLES 32 AND 38 OF LAW No. 9.605/1998 ON ENVIRONMENTAL CRIMES FROM THE PERSPECTIVE OF THE MILITARY POLICE

Brazilian reality and, more specifically, focuses on the discussion of Articles 32 and 38. Environmental issues involve collective co-responsibility in promoting the common good, considering both current needs and the protection of the interests of future generations. The research problem consists of analyzing how legal provisions for environmental protection have been operationalized, identifying the main obstacles that compromise their effective application, and examining how the actions of public agents influence the implementation of the environmental protection established by current legislation. The study adopted an explanatory methodological approach, based on documentary research and qualitative analysis, aiming to examine the effectiveness of Articles 32 and 38 of Law No. 9,605/1998, which refer to crimes against fauna and flora. The investigation made it possible to interpret legal, institutional and operational aspects related to the application of the Environmental Crimes Law and environmental protection. Despite the advances observed, there is a need to reassess the legislation after more than two decades of enforcement, in view of social transformations and new demands for environmental protection. The role of the Military Police in monitoring and enforcing the law is also highlighted, as well as the importance of regulatory updates and proportional revision of sanctions to strengthen its effectiveness.
