THE INSTITUTE OF POPULAR INITIATIVE AND ITS SETBACKS IN APPLICABILITY UNDER LAW No. 9,709/1998
Abstract
Popular initiatives are one of the main instruments of direct participation provided for in the Brazilian legal system, allowing citizens to participate in the drafting of laws and contribute directly to the legislative process. This mechanism is provided for in Article 14 of the 1988 Federal Constitution and regulated by Law No. 9,709/1998, which establishes the formal requirements necessary for its use. The present study aims to analyze the importance of popular initiative as an instrument for strengthening democracy and, at the same time, to examine the practical obstacles arising from the legal requirements for its applicability. The research shows that, although popular initiatives represent a significant advance in expanding citizen participation, their implementation faces difficulties related to legal requirements, especially with regard to the collection of signatures and the formal criteria established by law. It concludes that popular initiatives are a relevant instrument for strengthening democracy, but that their practical applicability still faces structural limitations that hinder their full use in the Brazilian context. To this end, qualitative methodology was used through bibliographic and normative instruments, together with a quantitative approach, which used the total number of Brazilian voters to bring to the factual plane what is written only in the ideal plane of legal rules, which sometimes cease to be compatible or viable with social reality.
