THE STRUCTURAL ROLE OF THE PUBLIC PROSECUTOR'S OFFICE IN PROTECTING THE RIGHTS OF TRANSGENDER WOMEN IN THE BRAZILIAN PRISON SYSTEM
Abstract
This article analyzes the structural role of the Public Prosecutor's Office in guaranteeing the fundamental rights of transgender women in the Brazilian prison system. It begins with the observation that the transgender population constitutes one of the most vulnerable groups in the prison context, frequently exposed to rights violations, discrimination, and institutional violence. The research adopts a qualitative approach, with a deductive method and documentary analysis of constitutional norms, infra-constitutional legislation, and institutional resolutions related to the protection of the LGBTQIA+ population in the penal system, especially CNJ Resolution No. 348/2020. The study examines the instruments of action of the Public Prosecutor's Office, such as prison inspections, administrative recommendations, terms of adjustment of conduct, and public civil actions, evaluating their capacity to promote structural changes in the prison system. It concludes that, although there are normative and institutional advances aimed at protecting gender identity in the prison system, the performance of the Public Prosecutor's Office still faces limitations arising from institutional obstacles, regional inequalities, and structural resistance in prison administration.
