THE ONLINE CONSUMER, THE CONSUMER PROTECTION CODE AND THE GENERAL DATA PROTECTION LAW
Abstract
This work shows how the consumer who uses the internet, on the computer or on his cell phone device, has legal protection and receives state protection. This reflection brings the discussion as to how technology needs to be in favor of man, as well as the Law. The Consumer Protection Code, Law 8,078/90, came after the Federal Constitution. It protects consumer relations and protects the vulnerability of the person when compared to the company or service provider. Therefore, it needs to be adapted to the new reality, due to its age. The General Data Protection Act is later. Enacted on August 14, 2018, it was changed by Law No. 13,853/2019 and Law No. 14,010/2020. It is rich in detail, but will certainly receive new updates. Thus, the law and the operators of the law must monitor the instantaneous speed of virtual human relations, in particular the relationship of consumption for social peace and life in a balanced society.
