A PROMOTION TO CORPORAL AS A KEY ELEMENT TO MODERNIZE THE WORKFLOW OF THE DISCIPLINARY TRANSGRESSION REPORT FORM WITHIN THE MILITARY POLICE OF PARANÁ, WITH THE ENACTMENT OF LAW Nº 19.583/2018

Abstract

his article examines the functional attributions and a possible new mission for the Corporal rank of the Military Police of Paraná – PMPR, with the advent of Law No. 19,583, dated July 5, 2018, which amended provisions of Law No. 5,940, dated May 8, 1969 – the Law of Promotions for Enlisted Personnel of the Military Police of Paraná. The topic is unprecedented and of great relevance, as it is directly related to the instruction and progress of Administrative Disciplinary Processes and Procedures within the PMPR, impacting directly on the services provided by the Institution to Society. Unfortunately, there is no specific material on the proposed topic; therefore, an analogy with the civilian and legal world will be applied. This will demonstrate the concern and importance of this study, keeping pace with the evolution – respecting the organizational culture of the PMPR – of laws, decrees, ordinances, and guidelines related to these Disciplinary Processes. We will analyze important aspects of optimization and gain for the institution when applying the respective Graduates in the instruction of the Disciplinary Offense Investigation Form – FATD. It will be necessary to explore the legal basis that supports such application, and the following points will be presented: the characteristics of the ranks of 3rd Sergeant and Corporal; the basic characteristics of the FATD; where the guidelines align, allowing such application; the importance of evolution in methods; and, what will be the gain for the institution and especially for society.
