REQUIREMENT FOR THE CONSENT OF THE STATE PUBLIC SECURITY AGENCY IN MUNICIPAL PROJECTS OF CONSTRUTION OR REVITALIZATION OF PUBLIC SPACES

Abstract

This article addresses the issue of mandatory approval by the state public security agency operating in the municipality of projects involving the construction or revitalization of public spaces, such as squares and open spaces. This requirement is essential to ensure the circulation of vehicles and enable effective ostensive and preventive policing. The absence of this requirement has led to the creation of areas that are difficult for security forces to access, encouraging criminal activity. The overall objective of the study was to analyze the enforceability of the state public security agency's consent in municipal projects involving the construction or revitalization of public spaces, in light of applicable legal norms. In turn, the specific objectives sought to: identify the constitutional and legal grounds that justify the consent of the state public security agency in municipal urban projects; analyze the institutional role of this agency in the approval of projects for the construction and revitalization of public spaces; and, finally, to assess the legal and urban impacts of the prior consent requirement, considering the principles of legality, efficiency, and public safety. As a contribution, the research proposes the creation of regulations that require technical input from security agencies in the approval of urban projects.
