SLANDEROUS DENUNCIATION AGAINST STATE MILITARY PERSONNEL IN SERVICE

This paper presents, initially, an analysis of the most relevant aspects of the criminal type, provided for in article 339 of the Penal Code (BRAZIL, 1940), consistent with the crime of slanderous denunciation. It also reflects on the criminal and civil responsibility of the subject who is the author of the false imputation in the face of a military police officer regarding the commission of a crime (abuses, injuries) during the police approach, knowing that he is innocent. In the same way, it discusses the professional losses borne by the servers victims of slanderous denunciation, which are subjected to a rigorous disciplinary regime, guided by hierarchy and discipline. The objective of this article was to highlight the need for serious reprimand and supervision by the responsible bodies (Public Prosecutor's Office and Judiciary), considering the serious damages caused to security agents, as a way to mitigate and extirpate this practice repeatedly adopted by prisoners/accused who use an untrue accusation directed at the military as a way to impersonate innocent or get rid of prison. Finally, in the scope of the research, constitutional and legal provisions were analyzed, as well as judicial decisions and reflections on the illicit conduct on the part of the custodians/denounced and their consequences.
