STREET-LEVEL BUREAUCRATS, INSTITUTIONAL LOGICS AND LEGAL CONSCIOUSNESS: A THEORETICAL ESSAY FROM THE PERSPECTIVE OF POLICE ACTIVITY

Abstract

This paper examines how the activities of military police officers—viewed as street-level bureaucrats—interact with institutional logics and interpretations of the law to shape legal consciousness. Three main frameworks guide the analysis: Street-Level Bureaucracy (Lipsky), emphasizing the discretionary power of frontline agents; Institutional Logics (Friedland; Alford; Thornton; Ocasio; Lounsbury), which provide concurrent values and practices (military, legal, civil) within organizations; and Legal Consciousness (Ewick; Silbey), addressing how the “law on the books” differs from the “law in action.” Although norms and protocols exist, officers often adapt decisions to real-world constraints, thus uniquely interpreting institutional demands. This dynamic impacts collective perceptions of the law, as each encounter reinforces or questions its legitimacy. Focusing on the theoretical dimension, the discussion highlights how police organizations balance hierarchical, military-oriented structures with community-based needs, while situational discretion shapes citizens’ legal consciousness. The conclusion is that officers do more than just implement rules; they co-create the meaning of the law, influencing or undermining its social credibility.
