DEFENSIVE INVESTIGATION: ACTIVE PARTICIPATION OF THE DEFENDANT IN THE PRELIMINARY PHASE OF THE CRIMINAL PROSECUTION

The present study proposes a reflection on an institute little talked about in the Brazilian jurisdiction. The general objective of this work is to highlight the importance of the defensive investigation for the balance of criminal procedure, guaranteeing the accused an active position at the time of the investigations no longer remaining inert. It will be discussed about the main means of investigation used in the first phase of the investigation, which is the police investigation, taking into account article 155 of the CPP, and the possibility of the subsidiary conviction of the magistrate based on the elements gathered in the investigation. In addition, the defensive investigation in U.S. and Italian law will be briefly analyzed. Finally, it is proposed to the operated of law to adopt the defensive investigation, since with this form of investigation would provide the accused a greater parity of arms with the prosecution, in addition to strengthening the accusatory system that is adopted by the national legal system.
