Abstract

This Article addresses the structure of the Military Police Inquiry (IPM), with emphasis on the Military Police of the State of Paraná, bringing to the fore possible constraints against the military personnel being investigated, when at the IPM headquarters, they are victims of a premature indictment, without minimal evidence. of authorship and materiality, causing administrative, private and psychological disorders. When analyzing the Military Police Inquiry, focusing on the act of indictment, it is clear that such formality does not have a specific and clear provision in Brazilian legislation, despite being one of the main acts within an investigation, allowing it to occur in a discretionary manner in different phases of IPM. The absence of clear regulations on early indictment may result in losses for the soldier under investigation in his administrative, social, moral, professional and psychological aspects. The text aims to discuss the possibility of premature and unreasonable indictment, and the problems that the lack of specific guidelines for indictment can generate, defending the need for a more in-depth study on the topic.
