THE ACCUMULATION OF PUBLIC OFFICE IN THE SCOPE OF THE MILITARY POLICE OF PARANÁ: A POSSIBILITY OF READING IN THE LIGHT OF THE CONSTITUTIONAL AMENDMENT No. 101 OF 2019

The present article, through a qualitative and exploratory research, seeks to carry out a theoretical deepening in the face of the possibilities of accumulation of public positions in the scope of the Military Police of the State of Paraná (PMPR), bringing to the discussion several norms that deal with the subject , highlighting Constitutional Amendments (EC) No. 34 of 2001, EC No. 77 of 2014 and EC No. 101 of 2019, together with Information No. 39/2020 of the Attorney General of the State of Paraná - PGE/PCRH, which, in tight summary, greatly restricts the possibilities of accumulating public office by the state military. Thus, through an important discussion, invoking the reasons for EC nº 101 of 2019, when analyzing its project, as well as aiming at an interpretation according to the principles inscribed in our Federal Constitution, we seek to expand the list of possibilities for military personnel to states can fully exercise the positive rights, however, without disregarding the peculiarities and restrictions arising from military police activity, which ends up imposing limits on the enjoyment of such prerogatives.
